Fawley Gets Attorney Change
Task Force Still Seeks "GRN ERTH" Tag
by William Drummond

In a new development yesterday, Chris Collins resumed control of Benjamin Fawley's legal defense. Fawley faces 16 counts of possession of child pornography charges, stemming from images, including at least 30 movies, contained on computers seized in a search of his apartment. The prosescution believes that all of the pictures of "actual children" depicted in various sex acts. The children range in ages mostly between 10 and 14; however, some children as young as 1-year old are depicted in sexual acts. The prosecutioin continues to indicate that more charges are forthcoming in regards to the pornography, and perhaps because of Fawley's own admissions to having an illegal sexual relationship with Taylor. None of the pornography has featured Fawley or Taylor.
On Monday, Chris Collins was not at the arraignment for Ben Fawley, later saying that he was stepping aside on the case. Collins had been representing Fawley during the media fury that ensued when taylor Behl disappeared. During the arraignment hearing, Judge Kimberly O' Donnell determined that Fawley's only income derived from disability Social Security benefits received because of his bipolar disorder. Since Fawley has no means to provide for an attorney on his own, the court appointed a public defender to defend him. The announcement yesterday came as Richard Johnson, the public defender appointed by the court, took a page out of Collins' book saying he was stepping away from the case.

Police continue to ask for the assistance of the public in locating the car on which this personalized Virginia "400th Anniversary" plate has been seen. If you see this plate, notify the Richmond Police Department, or the local police jurisdiction where you see it. Please try to note the type of car, a description of the driver, the place and time, and if there are any distintive markings on the car. If safe to do so, use a cell phone to make the report. Do not take any risks with your own safety, however.
Beyond telling the media that the plate was reported missing during the same time frame that Taylor vanished. Police spokesperson Kirsten Nelson told the media, "The license plate means something to us but we are not prepared to say what at this time." Earlier reports indicated that the police suggest that the plate "may have been" in Fawley's possession at one time. The police do say the owner of the plate is in no way connected to the case.
Investigators met with Taylor's mother, Janet Pelasara and discussed the significance of the tag, but have asked that those details not be made public. George O. Peterson, a friend of the family as well as their attorney, says that the information is not suggestive one way or another as to the well being of Taylor. "Janet came away from that meeting very encouraged by the manner of investigation and that we would suspect significant activity," he said. "The case is not by any means at a stalemate." Ms. Pelasara had been critical of the investigation while it was under the control of VCU and the campus police. She said that she felt they did not have the necessary expertise and experience in these types of cases. She had strong feelings about VCU's delay in relinquising control of the case to the Richmond PD. Since the Richmond PD, the FBI, and the rest of the task force have been involved, she has felt a lot more confidence in the liklihood of a positive outcome.
Following publishing copies of the search warrant and the list of items seized by the investigators from Fawley's home, the police now say that Taylor's cell phone, keys, student ID were not among the items recovered in the search. The police continue to withhold further comment about the significance, if any, in the rest of the items they collected. All they will say is the further analyis is ongoing, and that it would be premature and likely detrimental to the investigation to go into any detail.
Fawley has a long history of lawlessness stretching back many years. From the many media reports about his criminal history, the below list represents that history:
  • Felony auto theft in Ohio, served three years (OH)
  • Car theft in PA, unclear if any time served (PA)
  • Arrested for failure to pay fines and court costs in (PA)
  • Arrested for trespassing, unknown outcome (Richmond)
  • Assault - domestic violence, 30-day suspended sentence (Richmond)
  • Assault - domestic violence, 2004, unknown outcome (Richmond)
  • Assaut, unknown outcome (Richmond)
  • other miscellaneous misdemeanors
