Fawley With the Legal Razzle Dazzle


WRIC, Channel 8 News is reporting that Chris Collins is stepping back to the defense table, relieving the public defender appointed to defend Fawley against the 16 charges of possession of child pornography. Without giving a reason at this point, Channel 8 News says that Richard Johnson "stepped away from the case." Prosecutors expect that more charges stemming from the child pornography are forthcoming.



In an effort to get Taylor's face out to as many people as possible, the Virginia State Police are passing out flyers to the public at the Virginia State Fair in Henrico County. The police are still seeking information about the personalized VA license plate "GRN ERTH." The tag was stolen during the same time frame that Taylor disappeared. Some sources are reporting that it is possible the tag was in Fawley's possession at one point. Fawley brags about his license plate collection on at least one of his online journals.
The following information is what the police need to determine if the plates have anything to do with Taylor's disappearance. If you see the car, make note of the information listed below, then call the police at (804) 514-TIPS. If you are able to safely call the police from a cell phone, please do so.

> where was this car seen
> when was this car seen
> who was driving the car (description, identifying marks, etc.)
Channel 8 also says that Richmond prosecutors will receive a boost from the Virginia Attorney General's office, who have been active with the task force trying to find Taylor. Appearing to address statements by Collins several days ago, who said that any pornography belonged to former roommates of Fawley, Richard Campbell, Deputy Attorney General, had this to say, "I'm very confident that law enforcement has done a good job in this search warrant. It's not the first time that I've heard a defendant say it's not mine whether it's in regard to drug possession or possession of child pornography." Heading off one of the more recent defenses used by child pornographers, Campbell says that he doubts that any of the images are 'morphed.' "In a case of a person whos's skilled in photography it's likely you're going to be dealing with real images- there's no need to morph images," he told Channel 8 News.


The Search Warrant
My Analysis of the Items Sought and Seized

Today is the last day of September, and 10:30 P.M. EDT, tonight marks the 25th day since anyone has confirmed seeing Taylor. Yesterday, I posted copies of the search warrant that authorized police to search Fawley's apartment, as well as lists from the Richmond Police Department and the FBI, showing what they collected from Fawley's apartment.
From previous accounts, we know that Taylor should have had her car keys, some kind of identification, her cell phone, a little cash, a skateboard, and of course, the clothing she wore that night. Reading through the lists, one finds that among the items seized "cell phones (3)," "ID's," and "photo copies of ID's." Reading the warrant provides a detailed list of the items the police sought: but, the warrant does not draw any correlation between Taylor and the items sought. The warrant specifically listed items that they hoped to find; the parenthetical notations are added to show whether or not these items were seized during the search:
  • blue jeans, women's (seized blue pants and bags of generic clothes & shoes)
  • black hoodie (seized bags of generic clothes & shoes)
  • sweatshirt (seized bags of generic clothes & shoes)
  • black cargo shorts (seized by the FBI)
  • yellow T-shirt (seized)
  • running shoes, women's (seized bags of generic clothes & shoes)
  • St. Francis medallion and necklace (chain w/cross from supercan outside)
  • silver motorcycle chain link necklace (bicycle chain necklace seized)
  • watch with a black band (watch from supercan outside)
  • bracelets
  • any of Fawley's clothing with dirt, mud, or grass (unknown if any of the clothing met this description)
  • VCU ID, including Taylor's (ID's and photocopies of ID's seized)
  • cell phones, including Taylor's Nokia (3 cell phones seized)
  • vehicle license plates
  • linoleum knives (machete seized)
  • hammers (seized from garbage outside)
  • shovels
  • pry bars (seized from garbage outside)
  • screw drivers
  • other burglary tools
  • $20 bills
  • keys (keys with no further description seized)
  • key rings, including Taylor's (keys with no further description seized)
  • vehicle keys, including for a Honda Civic (keys with no further description seized)
  • Pepperidge Farm cookie boxes (boxes of varying descriptions & content seized)
  • skateboards (5 skateboards seized)
The FBI's seizure list seems to be for items most likely associated with the collection of trace evidence. The FBI list includes 10 separate "VACCUMMING" entries, with no specific location indicated for each of the samples collected. The FBI also collected a fitted grey [sic] bed sheet, a fitted black bed sheet, futon cover, bra, hat, vacuum cleaner bag, and black cargo shorts from Ben Fawley.
According to the warrant, the search was to find evidence to prove that Fawley had violated VA statutes 18.2-370 taking indecent liberties with children, attempted, and 18.2-371 contributing to the delinquency of a minor. This gave the police and FBI the necessary authority to seize the many computer items, photo albums, sex toys, etc., that were collected during the search.
In fairness, many of the items sought in the warrant, and many of the items seized during the search, would have been collected at the home of the average citizen. Should the same warrant be executed in my home, just the clothing would require a small utility trailer to haul it away. The number of keys I have collected through the years is astounding. (I am afraid I will throw one away and then find something locked and no key.) While I have no skateboards, I suspect that the homes of younger adults, and homes with teenagers would reveal at least one skateboard. The jewelry sought by the authorities was a little more specific, and some of the items seized appeared to match the description. I collect watches, so the "watch with black band" would result in no less than 8 watches. In my garage are all of the old license plates I have had through the years. In various drawers around the house, you will find probably five or six old cell phones, though the police were likely more focused on looking for Taylor's. I am a "Mr. Fix-it" kind of guy, so all of the tools listed would be found inside of my house, in my garage, and in my vehicles. The term "burglary tools" is one that is highly subjective, thus gave the police wide latitude in what they could have collected. Proof that the police did not abuse that latitude is that the list of items they collected did not vary widely from the specific items they sought. Dinner knives can be used as a burglary tool, as can a wire coat hanger. I cannot imagine why the police expected to collect $20 bills from a man on disability, and one who had been robbed only days before the search.
While much speculation will abound about the aforementioned items, without the proper context, it is meaningless. For now, we must wait for the police to release information regarding the significance, if any, of the items they sought and the items they seized. We must also wait to find out if the FBI turns up any trace evidence, that when taken in context, has anything to do with Taylor's disappearance.
